1. General:
Our deliveries, performances and offers take place exclusively on the basis of this conditions. These are applicable also to all future business-relationships consequently even if they are not arranged again expressly. Deviations of this conditions are only effective if The Sailfactory confirms these in writing.
2. Prices, price-alterations and terms:
The prices are exclusively for package. The prices include the legal value added tax. A separately expelled value added tax is not possible on the basis of the fiscal legal form. The prices don 't comprise any discount or other estates. Other arranged additional performances and from us agreement in accordance with disbursed costs goes, as far as nothing else is in writing regular, at the buyer's expense. The buyer also has freight as well as package-costs to take over, it then is that was agreed expressly in writing different. Payment-condition is pre-cash. The proforma invoice must be paid immediately and without deductions - in as far as nothing else has been agreed upon in writing. A receipt of payment becomes within max. one week after purchase expected. After 30 days of default of the buyer, the company sailfactory hands over the demand to a suitable business. From this time is to be expected considerably higher costs for the buyer.
3. Order:
The order takes place per mail or fax. You get a confirmation of the purchase within one day and a proforma bill with statements to the bank-connection.
4. Delivery and danger-transition:
The delivery takes place at the delivery-address given by the customer. As soon as the delivery of the company sailfactory was handed over to a transport compaqny, the risk risk will be transferred to the customer. The goods are to be examined at once by the customer or a representative to see if any transport damages have been incurred. When goods are received and the packaging is damaged, the customer needs to do a written confirmation from the transport company to confirm the damages. Damages claims against the sailfactory because of default or delay are impossible, as far as neither premeditation nor rough negligence exists. Delivery times are, in principle, not binding unless a certain delivery time has been agreed from the sailfactory in writing.
5. Right of return:
The customer has the possibility to return all articles from The Sailfactory within one month without any indication of reason. After the goods have been returned and examined, the customer will receive his money back. The return must be announced in text-form by letter, fax, e-mail at the company-address. The period begins with receipt of the goods. To the maintenance, the timely dispatch of the retraction or the article suffices the retraction-period. The exchange is impossible for following articles and special versions: all types of trampolines, covers and other catamaran accessories ( according the german law § 312d 4.1 BGB ).
6. Retraction:
In case of retraction the goods must be securely packed for transport in the original packaging. The costs of return until € 40,- value of goods must be paid by the customer. If the value of goods are higher than € 40,- the costs will be paid by The Sailfactory. Returns the customer the received goods only in more worse condition, uncompletely or partially to us, the customer is responsible for deterioration, loss or other impossibilities.
The repayment of the purchase-price takes place on buyer wish per check as well as credit on the customer's account.
7. Guarantee:
The guarantee-period for new articles amounts 1 year. The guarantee-period for used articles amounts half a year. Different periods are stated in the article-description. Faults, lacks or damages, that are to be led back on the basis of culpable or improper treatment or improper mounting as well as application of inappropriate accessories or alterations of the original-parts of the buyer, are impossible from the guarantee.
Natural wear is impossible from the guarantee. If the article is used commercial, the guarantee is impossible. With only insignificant lacks, no resignation and guarantee-right is entitled the customer. If the buyer assumes the article despite knowledge of a fault, guarantee-claims only are entitled to the customer, if the customer informs The Sailfactory in writing. If the goods are flawed in any way, The Sailfactory can decide between remove the defect or provide a replacement. The Sailfactory removes the flaw within its own company and at its own cost.
8. Delivery conditions:
The shipping takes place through a suitable transportation company (f.e. by mail, post ). With knowledge of a package-number, the customer can check the tracking online by internet. The shipping-costs comprise postage, package and insurance.
9. Reservation of proprietary rights:
The goods remains our property until the complete payment. With default, we can resign from the purchase. As long as there is the reservation of proprietary rights, the customer can’t use the goods.
10. Area of jurisdiction:
The legal system of the Federal Republic of Germany applies exclusively. Place of delivery for all services resulting from business relations with The Sailfactory is Eglfing / Tauting.
11. Recyling law:
according to the law Verpackungsverordnung from 01.01.2009 we participate in the dual system of Zentek and hold a licence.
12. Final Clause:
If some of these regulations - for whatever reason - do not apply, the effectiveness of the remaining regulations is not affected.
